Patent infringement proceedings filed in the Federal Court of Australia
Deb Group confirms that, through its subsidiary companies Deb Worldwide Healthcare Inc and
Deb Australia Pty Ld, court proceedings alleging patent infringement were filed on Monday 18
April 2011 in the Federal Court of Australia against Kimberly-Clark Australia Pty Ltd.
The court documents allege infringement of Deb’s Australian patent number 2006222502
entitled ‘High alcohol content foaming compositions with silicone-based surfactants’ which was
filed on 7 March 2006 and granted in Australia on 27th May 2010.
Background
Deb Group launched its first foamed alcohol hand sanitisers to North American markets in 2004
with commercial sector sales in Australia commencing in October 2006 and sales to Australian
hospitals starting in January 2009, following completion of a rigorous Therapeutic Goods
Administration (‘TGA’) product registration process. These products, now principally branded as
Deb InstantFOAM and Cutan, produce luxurious foams of efficacious alcohol based sanitiser at
low pressure and are increasingly displacing gel and rinse products as the sanitiser of choice
amongst infection preventionists and healthcare professionals.
